| Terms and Conditions 1. Validity This website is owned and operated by Le chic goody.we retain the right to change our terms and conditions at any time and without giving notice. The terms and conditions which apply to any given transaction, are those which appear at the time the order is placed on the website. 2. Pricing, Product Descriptions & Availability All prices displayed on this web site are inclusive of VAT and exclusive of packing and delivery. Where images show complete party bags and party bag contents, this is for illustration purposes only. One party bag consists of one set of contents as described in the text. We will select one at random and you may not receive the same item as illustrated in the picture. Our item descriptions always state this where applicable. Where sizes of products are quoted these are only intended as a guide. Prices and availability are subject to change without notice. All products shown on the website should be in stock. In the unlikely event that items ordered are out of stock we will inform you by email or telephone offering you an alternative, a new delivery date or an opportunity to cancel the order. 3. Ordering, Payment Options and Contract. Simply shop online placing the number of items you require into your trolley. Once you are satisfied that you have selected all the items you need, complete the purchase online. We accept all major credit cards and debit cards. (Please call us on 0208 2154623 via cheque). You will receive an email confirming receipt of your order. Once payment is successfully processed you will receive a second email confirming receipt of payment. This email also serves as official acceptance of your order. 4. Delivery Information Standard delivery is up to 5 working days. Orders received over the weekend will not be processed until the following working Monday or working day. We will guarantee next working day delivery before 1500 for a small premium if the order is placed by 12 noon. If a more urgent delivery is required please contact us on 0208 2154623 or email us on customerservices@lechicgoody.com If there is no one to accept delivery or the delivery is refused, information enabling you to complete the delivery will be left by the courier or the postman. We deliver to mainland England, Scotland and Wales. We are happy to deliver to other areas, but customers are asked to contact us for specific delivery costs. We try to dispatch orders within 24 hours of receipt, but cannot be held responsible for any loss incurred if we take longer to dispatch your order or if there is a delay in the delivery of your order. Please note that all references to dispatch and delivery times refer to working days Monday to Friday. Delivery occurs at the point when the items ordered have been left at the address specified by you. We cannot accept any claims if the items ordered are damaged beyond this point. 5. Packing and Delivery Costs Standard delivery to all UK destinations by Royail mail is at a fixed cost of £4.95 per order. Next week day guaranteed by 1500 (excluding bank holidays) with parcelforce to all UK destinations is at a fixed cost of £7.99 per order. 6. Substitution In the unlikely event that we run out of an item, we will substitute it for something that is just as appropriate and desirable. However, if the item we have run out of makes up a substantial part of the party bag, we will contact you as soon as possible, so that you can choose an alternative that you are happy with, or ask for a refund. 7.Cancellations, Returns & Refunds If you are not entirely satisfied with your purchase you can return the entire order to us.You must email us on customerservice@le chic goody.com or phone us on 0208 2154623 before sending items back stating the order number and the reason you are intending to return the goods. For a full refund,simply return all of the party bags to us upon receipt, we will provide you with a full refund or exchange (less original delivery costs). Returned party bags must reach us in their original packaging and original condition, for a full refund of the surplus party bags to be provided. We cannot accept responsibility for any loss or damage which occurs to items whilst in transit to us, or which occurs due to any other circumstances beyond our control. Return postage costs are to be paid by the customer. Returned goody bags must reach us in their original packaging and original condition, for a refund or exchange to be provided. We cannot accept responsibility for any loss or damage which occurs to items whilst in transit to us, or which occurs due to any other circumstances beyond our control.We strongly recommend that you gain proof of posting. Once received and checked we will issue a refund via the original payment method. For part Refunds: if you have over-ordered, we are happy to provide a full refund on any unwanted/surplus party bags, up to 30 days after placing your order. Simply return the extra goody bags to us upon receipt, we will provide you with your refund. Return postage costs are to be paid by the customer. Returned party bags must reach us in their original packaging and original condition, for a full refund of the surplus party bags to be provided. We cannot accept responsibility for any loss or damage which occurs to items whilst in transit to us, or which occurs due to any other circumstances beyond our control. 8.Loss or Damage in Transit If your order has not arrived within 7 working days of receipt of our order acceptance, please let us know immediately on 0208 2154623 or customerservices@lechicgoody.com and we will track the shipment. Should it prove to be lost we will reship as soon as possible. if any part of your order is delivered to you in a damaged state, please notify us, preferably by email, within 24 hours of delivery of your order. Please then return the damaged items to us and on receipt, we will gladly provide you with a refund or an exchange. We will also cover all reasonable postage costs incurred. If we are not notified of any damage within the 24 hour period stated above, it will be deemed that your order has been delivered to you in a good and satisfactory state. After the expiration of this 24 hour period, no refund or exchange can be offered based on a claim for damaged goods. 9.Safety Please note that no items are suitable for children under 3 years old unless specifically stated. It is your responsibility to check the suitability of these items for the age of the children for whom you are purchasing.The optional confectionnary,can be a choke hazard. We can not guarantee that they are nut free. the bags and contents that make up the goody bags are unsuitable for children under the age of 36 months( unless specifically stated )due to, but not limited to, small parts which may present a choking hazard, or sharp points which may cause injury, or the risk of suffocation from the bag itself. Therefore, our goody bags must not be given to children under 36 months(unless specifically stated )We do not accept liability for any injury, damage or loss which occurs due to the bag or its contents, getting into the hands of a child under 36 months. We supply our party bags with a warning label stating that the bag and the contents are unsuitable for children under 36 months. The customer must not remove, or allow anyone else to remove this label. This also applies to any other labels or packaging that appear on the goody bags or any of the items therein, which provide warnings, safety information, instructions or any other information. We do not accept liability for any injury, damage, or loss that occurs due to any of the labels or other information, as stated above, having been removed. We can not guarantee that they are nut free It is the responsibility of the customer to ensure that our party bags are not given to anyone who may have an allergy or any other specific condition, which may make the party bag or its contents unsuitable or harmful to them. We do not accept liability for any injury, damage or loss that may occur due to our party bags having been given to anyone for whom they were unsuitable, as detailed above. 10. Validity If any part or parts of these terms and conditions are deemed invalid, void or unenforceable, they will be considered severable from these terms and conditions. However, this will not prevent the remainder of these terms and conditions from being enforceable or effective 11.Privacy policy Any information you provide us so that we can satisfy your order and future orders as efficiently as possible is treated as strictly private. We do not pass on or sell any information to 3rd parties. We are registered as required by the Data Protection Act 1998. We may send out newsletters from time to time or notification of special offers. You can unsubscribe from these mailings at any time by emailing us at unsubscribe@allaboutpartybags.co.uk from the email address we have registered for you or by writing to us. 12. Copyright All of the website design, logos, graphics, text, and the arrangement and selection thereof, are the sole property of le chic goody. All rights are reserved. Permission is given to print hardcopies of sections of this website, for the sole purpose of placing an order. It is strictly prohibited to print out sections of this website for any other purpose, or to modify, distribute or republish any part of it, without our prior written permission. 13. About You You promise that you are at least 18 years old and have the legal right and ability to enter into this agreement and to use any debit or credit card used to purchase products on this website. You promise that all of the information you have provided is accurate and true. You authorise us to perform validation checks and authorisation with the card issuer. 14.General Liability We are not liable for any loss of profit, loss of business or any other consequential, special or indirect losses, costs, expenses or other claims for compensation, whether caused by our negligence or not, in connection to the products offered for sale on this website or their use or the manner in which we have delivered our services. We are not liable to pay you any compensation other than a refund equal to the price of the products that you have paid for. 15.Refusal we reserve the right to refuse any order or transaction, for whatever reason and without giving notice, whether or not monies have been paid. 16.Governing law Your use of this website and any purchase made by you on this website of any products, or the use by any third party of any of the products supplied by us through this website will be governed by English Law and will be deemed to have occurred in mainland United Kingdom.
